Bose is currently facing a $5 million lawsuit because of its headphones. The headphones reportedly spies on users.

This Bose app collects user's information of the users and transmits them to third parties including a data mining company called Segment, according to Vocativ.

Zak and his lawyer claim that the transmission of the data violates the Wiretap Act. It also violates some privacy laws of the state. Zak and his lawyer indicated that the company needs to be clear as to what is done with the information taken. There has been no statement from Bose regarding the lawsuit yet.

The lawsuit claims that customers who purchased the QuietComfort 35, QuietControl 30, SoundLink Around-Ear Wireless Headphones II, Soundlink Color II, Soundsport Wireless and SoundSport Pulse Wireless are at risk when they use the device's app.

Meanwhile, Zak and his lawyer will need proof to show that Bose is taking its user's data and sending it to a third party, Ars Technica reported.

Zak's lawyer said that the issue was discovered from the in-house computer forensics lab of the law firm. The suit is calling the company to stop the collection of data of people using Bose headphones.

Zak has also initiated a class-action status for the damages that the company has done regarding the information that has been transmitted to third parties. The transmitting of the data was carried out without the permission of users and is an invasion of privacy.
